Welcome to Simmons Enterprises (“we,” “us,” “our”). These Terms & Conditions (“Terms”) govern your access to and use of simmonsenterprises.store (the “Site”), including any purchases of products, digital downloads, or services offered through the Site.

By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

We offer physical products (such as books, merchandise, and prints), digital products (downloads), and services (consultations/workshops/lessons).

We make reasonable efforts to display accurate product details, photos, and pricing, but we do not guarantee that descriptions, images, or other content are error-free. Colors and appearance may vary by device.

We reserve the right to:

  • limit quantities per order,

  • discontinue products/services without notice,

  • refuse or cancel orders due to suspected fraud, abuse, or technical/pricing errors.

6) Pricing, Payments, and Promotions

Prices are shown at checkout and may change at any time. Discounts and promotions may have limits, expiration dates, or additional rules stated at the time of the offer.

Payment is due at the time of purchase. We accept the payment methods displayed at checkout.

Pricing errors: If a product is listed at an incorrect price due to a mistake, we may cancel the order and issue a refund.

7) Order Acceptance and Cancellations

After you place an order, you may receive an order confirmation email. Order confirmation does not guarantee acceptance. An order is considered accepted when it is processed and/or shipped (for physical items) or delivered (for digital items).

We may cancel or refuse orders at our discretion, including for:

  • suspected fraud,

  • incomplete or inaccurate shipping information,

  • pricing or inventory errors,

  • violation of these Terms.

8) Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy.

International Shipping: We offer international shipping. Customers are responsible for all taxes, tariffs, duties, customs fees, and import-related charges imposed by the destination country or carrier. These charges are not controlled by Simmons Enterprises and are not included in our item prices or shipping charges unless explicitly stated at checkout.

Delivery timelines are estimates and are not guaranteed. Risk of loss typically passes to you upon delivery as confirmed by the carrier.

9) Returns and Refunds

Returns and refunds are governed by our Refund Policy. Please review it before making a purchase.

10) Digital Products (Downloads)

For digital products, you agree that:

  • delivery is electronic (download link, file access, or email delivery),

  • you may use the product for personal use only unless otherwise stated,

  • you may not resell, redistribute, share, post, or upload the digital files to public sites, file-sharing platforms, or marketplaces.

All digital sales are final once delivered or accessed, except where required by law or if we provide the wrong file.

11) Services and Bookings

If you book a service through the Site (consultations, lessons, workshops), you agree to:

  • provide accurate contact information,

  • attend on time and behave respectfully,

  • follow any booking, cancellation, and rescheduling rules displayed at checkout.

We may reschedule due to emergencies or unforeseen conflicts. If we cancel and cannot reschedule, we will refund the service fee.

12) Intellectual Property

All content on the Site—including text, graphics, logos, images, product descriptions, and digital downloads—is owned by Simmons Enterprises or used with permission and is protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from Site content without written permission, except as allowed by law.

13) User Content (Reviews, Comments, Submissions)

If you submit content such as reviews, comments, testimonials, photos, or messages (“User Content”), you agree that:

  • your submission is accurate to the best of your knowledge,

  • you have the right to share it,

  • it does not violate any law or third-party rights.

By submitting User Content, you grant Simmons Enterprises a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and publish it for business purposes (for example, marketing, product pages, or social media), unless you request otherwise in writing.

14) Prohibited Uses

You agree not to:

  • use the Site for unlawful purposes,

  • attempt unauthorized access to the Site, accounts, or systems,

  • interfere with Site security, performance, or functionality,

  • scrape or harvest data without permission,

  • upload viruses or malicious code,

  • impersonate another person or provide false information.

The Site and all products/services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, except where prohibited by law.

We do not guarantee that:

16) Limitation of Liability

To the fullest extent permitted by law, Simmons Enterprises will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to:

You agree to indemnify and hold harmless Simmons Enterprises from claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising from:

If a dispute cannot be resolved, it will be handled under the governing law and venue described below, unless otherwise required by law.

19) Governing Law and Venue

These Terms are governed by the laws of the State of West Virginia, United States, without regard to conflict of law rules. Any legal action relating to these Terms will be brought in the appropriate courts located in West Virginia, unless otherwise required by law.

20) Severability

If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

21) Entire Agreement

These Terms, along with our Shipping Policy, Refund Policy, and Privacy Policy, constitute the entire agreement between you and Simmons Enterprises regarding use of the Site and purchases made through it.
